1. Introduction

These Terms of Service (“Terms”) set out the legal terms and conditions on which Alpharo Design Ltd (“we”, “our”, “us”) sells products (“Products”) listed on our website to consumers. By accessing or using our website, you agree to be bound by these Terms. If you do not accept these Terms, you must not use this website or purchase Products.

3. Eligibility to Purchase

By placing an order with us, you warrant that you are:
(a) Legally capable of entering into binding contracts;
(b) At least 18 years old; and
(c) Providing accurate, current, and complete information.
We reserve the right to refuse orders that do not comply with these requirements.

4. Contract Formation

After you place an order through our website, you will receive an email acknowledging that we have received your order. This email does not constitute acceptance of your order. A legally binding contract between you and us will only be formed when we send you an order confirmation email, at which point we are accepting your order and are committed to dispatching the Product(s). If we are unable to fulfil your order, we will inform you and refund any amounts paid.

5. Product Information

We strive to ensure that all descriptions, images, and specifications of Products are accurate. However, we do not guarantee that the depiction on your device accurately reflects the Product’s appearance, and slight variations may occur. All Products are subject to availability. We reserve the right to discontinue any Product at any time.

6. Pre-Orders

Some Products may be offered for pre-order prior to general availability. By placing a pre-order, you agree to the following terms:
(a) Pre-orders are paid for in advance and the estimated delivery dates are approximate.
(b) The final Product may be subject to reasonable minor revisions and changes in specification and design from website descriptions and website imagery.
(c) Pre-orders may be cancelled by the customer prior to dispatch. If cancelled over 14 days after pre-order, a 5% restocking fee will be applied.
(d) If we are unable to fulfil your pre-order, we will issue a full refund.
(e) Alpharo is not liable for delays in production or delivery unless these amount to a breach of contract or statutory duty.

7. Prices and Payment

All prices are listed in GBP and include VAT (where applicable for UK orders). Delivery charges, duties, or import taxes may be added at checkout or upon delivery, depending on your country. We accept payment via major credit and debit cards through our processor, Shopify Payments. Orders will not be dispatched until full payment is received and authorised.

8. Shipping and Delivery

We offer worldwide shipping. Estimated delivery times are provided at checkout and are not guaranteed. You are responsible for ensuring that all delivery information provided is accurate. We are not liable for failed deliveries due to incorrect address information. Risk in the Product passes to you upon delivery. Title to the Product passes upon receipt of full payment.

9. Right to Cancel and Returns

If you are a consumer based in the UK or EU, you have a legal right to cancel your order within 14 days of receiving the Product. To exercise this right, you must notify us in writing and return the Product within 14 days of notification. Products must be unused, in their original packaging and in resalable condition.
(a) If the Product is faulty, we will cover the cost of return shipping.
(b) If the return is for any other reason, you are responsible for return shipping and a 5% restocking fee will apply.
Refunds will be processed within 14 days of receipt of returned goods.

10. Warranty

All Alpharo watches are covered by a two-year limited warranty from the date of delivery. This warranty covers manufacturing defects under normal use. The warranty does not cover:

• (a) Normal wear and tear;
• (b) Damage due to misuse or negligence;
• (c) Water damage outside rated tolerance;
• (d) Routine maintenance such as accuracy adjustments or de-magnetisation;
• (e) Repairs carried out by unauthorised parties.
  

If you believe your Product is defective, contact us at hello@alpharo.co.uk with your order details. We reserve the right to assess the Product before approving warranty coverage. You’ll need to cover the cost of shipping the product to us, but if your repair is covered under warranty, we’ll send it back free of charge.

11. Intellectual Property

All content on this website, including logos, text, images, graphics, and product designs, are the property of Alpharo Design Ltd or its licensors. No content may be reproduced, modified, or distributed without our prior written consent.

12. Limitation of Liability

We are responsible for foreseeable losses caused by our breach of these Terms. We are not liable for:
(a) Indirect or consequential losses;
(b) Business losses;
(c) Loss of data or profits.
Nothing in these Terms excludes or limits liability for death, personal injury, fraud, or statutory rights.

13. Governing Law and Jurisdiction

These Terms are governed by English law. Disputes may be brought in the courts of England and Wales. If you are a consumer in Northern Ireland or Scotland, you may bring proceedings in your local jurisdiction.

14. Changes to These Terms

We may amend these Terms from time to time. Changes will be posted on our website. Continued use of the site after changes are made constitutes acceptance of those changes.
